| Cheryl Voight applied to the city of Medford, Massachusetts for a permit to open The House of Pain, a tattoo parlor. At a public hearing, the Medford city counsel denied her application because Medford citizens are offended by tattoo parlors. Cheryl sued and won. Tattooing is expression protected by the first amendment. Government may not base a restriction on the content of expression; in this case tattoos. Also, when government uses vague standards to limit the time, place and manner of expression, it is censorship in violation of the first amendment. |
