Troy Whitaker was on parole and living in a half way house in Ohio. He was sentenced back to prison for a year after refusing to cut his hair citing Native American religious beliefs. Whitaker sued. Because he was unable to prove Native American lineage, the trial judge ruled against him . On appeal, Whitaker won. The test is not whether one is ethnically entitled to hold a religious belief, but whether the belief is sincerely held.
