Tom Leonard owned the towing company exclusively used by the city of Montrose, Michigan. Political differences arose and the city stopped using Leonard’s company. Leonard sued. At a city council meeting, Leonard accused council members of cheating his family and said “That’s why you’re in a goddamn lawsuit.” He was arrested for obscenity and disorderly conduct. Peacefully advocating a political idea through the use of profanity is protected by the first amendment.
