He was fined because an employee of the store had been standing on a street corner holding a sandwich board that read “Fresh Bagels-Now Open.” The ordinance prohibited portable signs but exempted ten categories of speech including real estate sale and political signs. The first amendment forbids government viewpoint discrimination.
