A convicted sex offender in a New Hampshire prison was promised parole upon completion of a sex offender program. The program included religious subject matter. The inmate sued alleging an establishment clause violation. Required participation in a religiously based program as a condition of release was found to be unconstitutionally coercive. Even sex offenders receive first amendment protection from government establishment of religion.
