New York state law requires employers who provide health insurance for employees to cover contraception. To preserve first amendment free exercise of religion there is an exemption for “religious institutions.” A state appellate court decided religious institutions, when engaged in non-religious activities, are not exempt. Employees of Catholic Charities, a social services government contractor, are entitled to insurance coverage for birth control.
