In Connecticut, a man was arrested and handcuffed for violating his probation and said to the officer, “I’m gonna kick your fucking ass.” The man was convicted of threatening to commit a crime. The man argued because he was handcuffed, and because he was speaking to a police officer - not an ordinary citizen - his speech could not have created the requisite element of fear and was therefore protected by the first amendment. He was unsuccessful.
