| The entrance to Marine World in Vallejo, California is on public land. Marine World prohibits all public assembly on “high volume days” defined as Memorial Day, Labor Day, July 4th, and Easter weekends. A small group of animal rights activists sued for the right to stand, hold signs and distribute leaflets on Memorial Day weekend. A federal judge ruled Marine World’s rules violate first amendment guarantees. The goal of crowd control and safety must be narrowly achieved. Prohibiting all speech goes too far. |
