On a 6 to 3 vote, the Senate Judiciary subcommittee on the Constitution approved a proposed constitutional amendment to ban flag desecration. The measure has already been approved by the House. The U.S. Supreme court has ruled twice - once in 1989 and again in 1990 - that flag desecration amounts to free speech protected by the First Amendment. Supporters argue the amendment addresses behavior, not speech.
