| An Ohio prison chaplain refused to allow an openly gay inmate to lead the choir. After warnings, prison officials disciplined the chaplain for refusing to obey their order to allow the inmate to lead. The chaplain argued his stand against allowing homosexuals to serve as church leaders was speech relating to a matter of public concern. He sued for employment retaliation and lost. He was not disciplined for speech but insubordination. To the extent his insubordination was speech, his first amendment right is outweighed by the state’s interest in an orderly administration of the prison system. |
